TERMS & CONDITIONS OF SALE

Purpose

These Terms & Conditions of Sale (“T&Cs”) govern product sales on the website https://www.domaine-amiotguyetfils.com/ (the “Site”), operated by SARL GUY AMIOT ET FILS, with share capital of €115,200, registered office at 4 place du Grand Puits, 21190 Chassagne-Montrachet, registered with the Dijon Trade and Companies Register under No. 444 671 788, EU VAT FR 814 446 717 88 (the “Seller”).

2. Scope

These T&Cs apply, without restriction or reservation, to any order placed by a consumer within the meaning of the French Consumer Code, for delivery within the areas served as listed on the Site. Order validation constitutes full and unconditional acceptance of the T&Cs.

3. Protection of minors & alcohol

Alcohol sales are strictly prohibited to minors. By ordering on the Site, the purchaser declares that they are at least 18 years old. The carrier may verify age upon delivery. Alcohol abuse is dangerous for your health—please drink responsibly.

4. Products, vintages & availability

Essential product characteristics (appellation, vintage, volume, allergens, alcohol content) are presented on the product pages.
Offers are valid while stocks last. If an item is unavailable after ordering, the Seller will offer: (i) a refund, or (ii) a vintage change or cuvée of equivalent quality/price, subject to the customer’s prior agreement.

5. Prices

Prices are shown in euros, all taxes included (TTC), excluding delivery charges (displayed before checkout). French excise duties are included. The Seller may change prices at any time; the price charged is the one in force at the time of ordering.

6. Ordering

The customer selects products, enters contact details, chooses the delivery method and confirms payment. The order becomes final upon email confirmation. The Seller reserves the right to refuse any abnormal or fraudulent order, or in the event of a prior dispute.

7. Payment

Accepted payment methods: [CB/Visa/Mastercard/Amex/PayPal] via a secure platform (3-D Secure where applicable). Your card may be charged upon dispatch or at confirmation, depending on the method chosen.
Retention of title: products remain the Seller’s property until full payment of the price (French Civil Code arts. 2367 et seq.).

8. Delivery

8.1 Areas, carriers & lead times

Delivery available to metropolitan France and EU countries (excluding islands) via Colissimo. Indicative lead times from dispatch: 2–3 business days within metropolitan France, 3–7 business days within the European Union.

8.2 Fees & conditions

Shipping fees are displayed before checkout. Delivery to door or to pickup point depending on the option available in the destination country.

8.3 Receipt, damage & breakage

Upon receipt, the customer must inspect the parcels. In the event of obvious damage (breakage, leakage, opened parcel), write specific, detailed reservations on the carrier’s slip, then notify the Seller within 48 hours with photos. After review, the Seller will replace or refund the damaged bottles.
Transfer of risk: at the time of handover to the customer.

9. Right of withdrawal (distance selling)

The customer has 14 days from receipt to exercise the right of withdrawal without giving a reason (French Consumer Code arts. L.221-18 et seq.).
To exercise it, send an unambiguous statement to contact@domaine-amiot.com or use the model form (see § 19).

Return the goods within a further 14 days, intact, unopened and undamaged, in their original packaging. Return shipping costs are borne by the customer, except where the Seller is at fault.
Refund within 14 days of recovery of the goods or proof of shipment, excluding any additional costs arising from a delivery method more expensive than the standard option.

Exceptions: no withdrawal for opened bottles, items damaged by the customer, or customized goods.

10. Conformity, “cork taint” & statutory warranties

The Seller is liable for statutory conformity warranties (French Consumer Code L.217-3 et seq.) and for hidden defects (French Civil Code 1641 et seq.).
For any lack of conformity, the customer may request remedy at no cost (replacement/refund).
Regarding cork taint, given the nature of the product, an exchange may be considered case by case within 30 days of receipt upon presentation of the bottle and cork (at minimum, photos and lot number), subject to availability.

11. Promotional programme

Promo codes: not cumulative with each other or with other offers; valid only for the stated period and while stocks last.

12. Customer account

Creating an account is optional. The customer undertakes to provide accurate information and to keep login credentials confidential.

13. Personal data

The processing of personal data is limited solely to what is necessary for order fulfilment and management of the online store. For more information about our Privacy Policy: contact@domaine-amiot.com.

14. Intellectual property

All elements of the Site (texts, visuals, logos, trademarks, databases) are protected and remain the exclusive property of the Seller or its partners. Any unauthorised reproduction is prohibited.

15. Force majeure

Neither party shall be liable for failure caused by an event of force majeure as defined by French law and case law (transport strikes, natural disasters, epidemics, etc.).

16. Mediation & dispute resolution

In case of a dispute, the customer should first contact customer service: contact@domaine-amiot.com.
If no solution is found within 60 days, the customer may use a consumer mediation service free of charge.

17. Governing law & jurisdiction

These T&Cs are governed by French law. The competent courts shall be those designated by general consumer law.

20. Additional practical information (wine)

Storage advice: cool, dark place with stable temperature; bottles stored on their side.
Vintage substitutions: only with the customer’s prior consent.
International deliveries: outside France, the customer is responsible for any local taxes/duties. Please check that importing alcohol is legal in your country/region.
